Definitions

  • "The Service" : Accessibility of legal information at website namely http://www.lawherald.org.
  • "The Data base" : Legal information in form of Judgments, Statutes and any such data or material available and added subsequently in the website.
  • "The "License" : Permission to access the database.
  • "The "Licensee" : Person subscribing to the service.
  • "The "Authorised Users" : Person permitted to use license by the licensee.
  • "Licence Fee" : Subscription paid for using the service.
  • "The Service Provider" : Owner of website i.e. M/s Law Herald Infotech, Chandigarh.

Termination of License

  • The Publisher/Service Provider may in its sole discretion cancel the license, without any prior notice, in case of violation of any terms and conditions of License or any misuse/overuse of data base by the licensee.
  • In case of termination of the License, the Licensee shall immediately cease to have any right in respect of the Database or any part of it as per policy of publisher/service provider.

Subscription

  • The License fee once paid is neither refundable nor transferable.
  • The License fee is subject to change anytime without prior notice.
  • The License fee once paid by licensee for a fixed tenure then any increase in license would not be applicable to him during that tenure.

Copyrights

  • All the database available on the website is copyrighted material protected by copyrights laws in favour of the service provider/the publisher.
  • All rights which are not expressly granted herein are reserved with the publisher/service provider.
  • Any infringement of copyrighted date/material in the data base would follow serious Civil and Criminal consequences.

Dispute Redressal

  • In case of any dispute relating to End User Agreement and its Terms and Conditions or any claims arising there from, that will be governed by Indian Laws and would be exclusively subject to jurisdiction of Courts/Forums/Tribunal at Chandigarh, India only.
  • Non-enforcing or delay in enforcing any terms and condition or any right vested with publisher/service provider would not be deemed to be waiver of its right to get it enforced.

Permitted Use

  • The Licensee is authorized to access the database only for personal use to fight a case in Court of law and for academic or educational research purpose only.
  • The licensee is authorized to reproduce the material in database strictly for usage as mentioned above. Licensee is required to include following statement in all reproductions of material. © All rights reserved with Law Herald Infotech.
  • The Licensee is strictly prohibited from using the database for commercial use in any manner whatsoever.
  • The Licensee is also strictly prohibited from using the license which is detrimental to commercial to any other interest of the publisher/service provider.
  • The Licensee shall not (and shall not permit any third party) to make any kind of alteration in any manner or by any means in the database or the software used in the website.
  • The Licensee understands and undertakes that the data base is to be used only as a reference and is not intended to be a substitute for professional legal advice.

Change in Terms
